The Conveyancing Process: What to Expect

The Conveyancing Process: What to Expect

Property transfers involve multiple moving parts. We simplify the timeline into clear, manageable steps:

1. Document Preparation & Verification

Once the Offer to Purchase (OTP) is signed, we gather all necessary identity documents, marriage certificates, and existing title deeds to draft the official transfer documents.

2. Financial & Municipal Clearances

We apply for the vital Rates Clearance Certificate from the Midvaal Local Municipality and request transfer duty receipts from SARS. We also coordinate with bond cancellation and bond registration attorneys.

3. Lodgement at the Deeds Office

Once all costs are paid and clearances are secured, we lodge the documents at the relevant  Deeds Office. The legal examination process usually takes 7 to 14 working days.

4. Registration & Payout
The property is officially registered in the buyer’s name. We finalize the finances, pay out the seller, and deliver the new title deeds.
Frequently Asked Questions (Meyerton Property Law)
How long does a property transfer take in Meyerton?
On average, a standard property transfer takes between 8 to 12 weeks from the date we receive the signed Offer to Purchase. Delays usually happen if municipal rates clearances take longer than expected or if there are complications securing a new home loan.
Who chooses the conveyancing attorney in South Africa?
By law and custom, the seller has the right to nominate the conveyancing attorney. This is because the seller remains responsible for delivering a clean title to the buyer, though the buyer is typically the party who pays the transfer fees.
What are transfer costs?
Transfer costs are the fees paid by the buyer to the conveyancing attorney for their legal services, along with government transfer duties (SARS taxes) and Deeds Office registration fees.
